The General Terms and Conditions of the Hempika online store have been drawn up in accordance with the Consumer Protection Act (ZVPot), Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).

The General Terms and Conditions set out the operation of the Hempika online store, rights and obligations of the user and the business relationship between the Company and the Buyer. The General Terms and Conditions also regulate individual rules of purchase at the takeover site of Hempika d.o.o.
The Buyer shall be bound by the General Terms and Conditions applicable at the time of purchase (submission of an online order). When placing an order, the User shall be made aware each time of the General Terms and Conditions and by placing the order, he confirms that he understands the General Terms and Conditions and agrees with them.
A user becomes a member by registering on the Hempika website. The right to purchase in the Hempika online store is given to all registered members as well as guests who do a quick order and do not register on the Hempika website before the purchase.
A user is any legal or natural person who uses or visits the Hempika website (hereinafter: the User).
By registering on the Hempika website, the User obtains a username, which is the same as his e-mail address and password. If at any time the User wishes to change his e-mail address or password, he can save it in his user profile.
All Users who submit correct information when registering can register on the Hempika website. All Users are responsible for the accuracy of the information provided. In the event that Users provide incomplete or incorrect information during registration, Hempika reserves the right to block the account. Hempika also reserves the right, in its sole discretion, to refuse to cooperate with anyone.
Duplicate registered accounts will be deleted immediately. The registered account is not transferable to another User.
Hempika undertakes to always provide the User with the following information:
Due to the nature of online business, the offer and prices in the Hempika online store may be often updated and amended. The price in the online store is the same for both registered members and users of the online store. All prices are in EUR, include VAT (the retailer is a taxable person), and are final. The Buyer is bound by the prices valid at the time of confirmation of his order. In the event that the prices change during the processing of the order, Hempika shall notify the buyer thereof. Prices in the online store are subject to change without notice.
Sale purchase agreement between Hempika d.o.o. and the Buyer in the online store Hempika is entered into at the moment when Hempika sends the Buyer the first e-mail confirming his order. From this moment on, all prices and other operating conditions are fixed and apply to both Hempika d.o.o. and the Buyer.
The sale purchase agreement is stored in an electronic form on the Hempika server and is available to Buyers upon their written request.
Packaging and delivery costs for purchases over EUR 30.00 are free and shipped with the GLS delivery service. Packaging and delivery costs for purchases up to EUR 30.00 are charged according to the following price list:
Personal collection at the registered address of Hempika d.o.o., Rejčeva ulica 5a, 5000 Nova Gorica, is also possible. In the event of personal collection, there are no collection costs.
All orders placed on working days before 1 pm, in the event of cash on delivery or paid by a payment card, will be shipped the same day. Orders with direct bank transfer will be sent immediately after receiving the remittance to the bank account. Orders made during weekends and holidays will be shipped immediately the following business day. With products where a longer delivery period is specially indicated, the latter shall be taken into account.
Warning: These Terms and Conditions, costs of packaging and delivery apply only within the Republic of Slovenia.
Packaging and delivery costs for purchases over EUR 99.00 are free and shipped with the GLS delivery service. Packaging and delivery costs for purchases over EUR 199.00 are free and shipped with the DHL delivery service. Packaging and delivery costs for purchases up to EUR 99.00 are charged according to the price list of a selected courrier (GLS, DHL or Pošta Slovenije).

After the delivery and payment of the ordered items upon takeover, Hempika also sends an invoice to the Buyer, either on paper or in electronic form to the specified address/e-mail address of the payer. The invoice breaks down the price and all costs related to the purchase. Before placing the order, the Buyer checks the correctness of data.
Promotional codes or coupons bring various benefits on purchase and are usually time-limited. Active promotional code or coupons can be found on the Company’s website, on the Company’s social networks, cover page of the advertising message, in the Company’s e-notifications or other media.
Exchange of the promotional code or cash coupon for cash is not possible. The promotional code or the coupon are redeemable only in full amount. In the event that the value of the purchase is higher than the value of the coupon, the holder of the promotional code shall pay for the difference. The purchase value shall be higher than the value of the coupon.

After placing an order, if the order has been successfully submitted, the Buyer receives an e-mail confirming his order. The registered members always have access to the information on the status and content of the order HERE.
To verify the information or to ensure the accuracy of the delivery, Hempika may call the Buyer to his contact telephone number.
As regards distance agreements, the Buyer has the right to notify the Company within 14 days to the e-mail address info@hempika.com that he is withdrawing from the agreement without having to state the reason for his decision. You can download the form for withdrawal from a distance agreement HERE.
The Buyer shall return the goods to the Company no later than 14 days following the notice of withdrawal from the order. The goods shall be returned to the following address: Hempika d.o.o., WITHDRAWALS, Rejčeva ulica 5 A, 5000 Nova Gorica, Slovenia. The only cost in connection with the withdrawal from the order, borne by the Buyer, is the direct cost of returning the goods (postage).
The Buyer must return the goods unused, undamaged, in the same quantity and in the original packaging, unless the product is destroyed, damaged, lost or its quantity has decreased without the fault of the Buyer.
Upon the return of the goods, the Buyer shall also send an invoice for the goods and personal information and the bank account number to which he wishes to receive the reimbursed payment. The payment will be reimbursed within 14 day from the receipt of the unused, undamaged goods, in the same quantity and in the original packaging, unless the goods are destroyed, damaged, lost or their quantity has decreased without the fault of the Buyer.
Upon withdrawal from the agreement, where the promotional code or a coupon were used, the funds are considered a discount and will not be returned to the Buyer. Only the paid amount is returned to the Buyer’s bank account, and at the same time the promotional code or coupon is returned to the Buyer.
The General Terms and Conditions below apply for the entry into distance sales agreements with legal entities via the Hempika online store, managed by Hempika d.o.o., which is also the provider of e-commerce (hereinafter: Hempika).
Companies, sole proprietors and other legal entities (hereinafter: legal entities) do not have the possibility to exercise the right to withdraw from a distance contract within 14 days, as is the case for the buyers (natural persons).
Refund of the purchase price for legal entities is not possible. For any conditions not determined by the these conditions of purchase, the provisions of the General Terms and Conditions of Operation of the Hempika online store shall apply.
Prior to the first purchase the users complete a Hempika B2B application, which will be approved by Hempika, following the review of all the information stated by the Users upon the application and the User’s agreement with the General Terms and Conditions of Operation of the Hempika website and Conditions of completion of the Hempika B2B application. By completing the Hempika B2B application, the user confirms and guarantees that he is the legal representative of the legal entity or that he is authorized by the legal entity to enter into sales agreements using information technology.
Legal entities can send any complaints regarding the purchase for legal persons to: info@hempika.com. The provisions of the Complaints and disputes section and other provisions of the General Terms and Conditions of Operation of the Hempika online store shall also apply mutatis mutandis.
The Hempika B2B application can be completed by any legal entity that provides correct information during registration and agrees to the General Terms and Conditions of Operation of the Hempika website and Conditions of completion of the Hempika B2B application.
Legal persons are responsible for the accuracy of the information provided. In the event that Users provide incomplete or incorrect information when completing the Hempika B2B application, Hempika reserves the right, in its sole discretion, to refuse to cooperate with anyone. In the event of a breach of these purchase for legal persons conditions, Hempika also reserves the right to block the approved Hempika B2B applications.
Legal entities may not complete more than one (1) Hempika B2B application. Any duplicate applications will be immediately rejected.
A completed Hempika B2B application is not transferable to other legal entities.
Hempika may, at its discretion, notify legal entities of the infringements and seek their correction. In the event of multiple violations, the approved Hempika B2B application may also be blocked.
All the indicated product prices are in EUR and include the value added tax (VAT). Delivery is not included in the prices.
The Hempika online store offers the following payment methods to the legal entities:
With individual orders, Hempika reserves the right to request direct bank transfer to the account of Hempika d.o.o. (in accordance with the offer/proforma invoice).
The purchase procedure for legal entities that select “Retail” or “Dropshipping” when completing the Hempika B2B application is identical to the one for natural persons using a coupon/promotional code. When completing the Hempika B2B application, legal entities that select the “Retail” program shall, upon approval of their application, receive a coupon of unlimited duration for a 40% discount on all products, and users of the “Dropshipping” program shall, upon approval of their application, receive a coupon of unlimited duration for a 25% discount on all products.
In the “White label” and “Bulk” programs, upon approval of their B2B application, legal entities receive a price list free of charge, which includes purchase conditions for legal entities of either the “White label” or the “Bulk” program, and represents the basis for further purchase procedure.
Conditions and procedure of using the coupon of unlimited duration for all products in the „Retail“ and „Dropshipping“ programs are as follows:
In the “Retail” program, for purchases over EUR 500.00, packaging and DHL delivery costs within the EU are free, for all shipments within the EU under EUR 500.00, packaging and delivery costs are charged according to the price list of the selected delivery method, for all shipments outside the EU, packaging and delivery costs are charged according to the DHL price list irrespective of the value of the purchase.
The “Dropshipping” program is available to legal entities that ship only to the following EU countries: Austria, Belgium, Czech Republic, France, Croatia, Italy, Hungary, Germany, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia and Spain.

For any conditions not specified by these Conditions of completion of the Hempika B2B application, the provisions of the Conditions of purchase for the legal persons and the General Terms and Conditions of Operation of the Hempika online store shall apply.
Hempika may, subject to its decision, at any time change these purchase conditions for legal persons. Hempika shall notify the Users of any changes to the purchase conditions for legal entities in a normally reliable manner (by posting on the website). It shall be deemed that the User accepts, understands and agrees with the amendments to the General Terms and Conditions, if following the publication of the amendments, he continues to use the Hempika website and online store.
Hempika shall be liable for clerical errors the item had at the time the danger passed to the Buyer, irrespective whether he was aware of it or not. Hempika shall also be liable for the clerical errors that appear after the danger has passed to the Buyer, if they are due to a cause that already existed before. A minor clerical error shall not be taken into account.
We will try to resolve any complaint as soon as possible and above all for the benefit of the Buyer. Complaints regarding the purchased goods shall be taken into account in accordance with the provisions of the Consumer Protection Act (ZVPot).
Hempika uses relevant technological and organizational means to protect the transfer and storage of personal data and payments.
Hempika d.o.o. and Bankart, Procesiranje plačilnih inštrumentov d.o.o. attends to the security of authorizations and credit card transactions. Credit card authorizations are performed in real time by immediate verification of data with banks. Card information is not stored on the server of Hempika d.o.o.

Hempika may contact the User by means of remote communication only if the User explicitly consents. Hempika shall explicitly respect the User’s wish not to receive advertising messages. Advertising e-mails will comprise of the following:
Opinions, ratings and recommendations written by users represent part of the functionality of the online store and are intended for the community of all users of the website.
Hempika allows the opinion to be written by any user of the online store, and they are additionally reviewed before the final publication. Hempika will not publish opinions or contributions that are in any way offensive, inappropriate or that, in its opinion, do not benefit other users of the Hempika website.
By submitting an opinion, rating and/or recommendation, the User of the website expressly agrees to the terms of use of his opinion, rating and/or comment and allows Hempika the publication of part or the entire text in all electronic and other media of the Company. Hempika has the right to use the content of the opinion, rating and/or comment for an indefinite period and for any purpose that is in the business interest of the company, including publication in advertisements or other marketing communications of the company. The author of the opinion, rating and/or comment simultaneously declares and guarantees that he is the owner of the moral copyrights for the written opinions, ratings and/or comments and that he transfers such rights non-exclusively and for an indefinite period to Hempika.

Hempika shall to the best of its abilities strive to ensure that the information, published on its website, is up-to-date and correct. Nevertheless, the characteristics of the items, delivery period and price may change so quickly that Hempika fails to correct the information on the website. In such a case, Hempika will notify the Buyer of the changes and offer a mutually satisfactory solution.
Hempika reserves the right to disable the website or disable access to it due to technical or other problems and maintenance, which also means disabling or impeding the use of the online store. In the event of technical problems on the website, Hempika reserves the right to cancel the placed orders affected by the technical error. In the event of cancellation of orders, Hempika shall inform the Buyers thereof as soon as possible and inform them of further steps.
The Users shall ensure the appropriate protection of the equipment against access to and use of the website. The Users shall ensure adequate security and confidentiality of the information used to log in to the website.
Hempika respects the applicable European consumer protection legislation and makes every effort to fulfil its duty to set up an effective scheme for dealing with complaints and to designate a person who in the event of a problem the Buyer can contact by telephone or e-mail.
A complaint shall be submitted via info@hempika.com. The appeal procedure is confidential. Hempika shall acknowledge the receipt of the complaint within 5 working days, inform the Buyer how long it would take to deal with it, and keep him informed of the progress of the procedure.
Hempika is aware that the essential feature of a consumer dispute, at least as far as judicial settlement is concerned, is its disproportion between the economic value of the claim and the costs incurred in the settlement of the dispute. This is also the main obstacle for the consumer not to initiate a dispute before the court. For this reason Hempika shall use its best endeavours to resolve any possible disputes amicably.
In the event of judicial dispute settlement, the court in Nova Gorica shall be competent to resolve the dispute which has arisen.
In accordance with the legal norms, we do not accept any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the consumer in accordance with the Out-of-Court Settlement of Consumer Disputes Act. Hempika, which as a provider of goods and services enables online trade, publishes an electronic link to the online consumer dispute resolution platform (SRPS) on its website.
